California Products Liability Lawyer

From defective medical devices to motor vehicle defects to workplace machinery, nearly every product on the market has the possibility of causing harm. Thankfully, most manufacturers take the time and care to make certain they aren’t putting unsafe products on the market. Unfortunately, some don’t.

The law firm of Rose, Klein & Marias LLP is here to see that those companies are held responsible for any harm caused by their products.

If you or someone you love has been hurt because of a defective product, we are here to help you.

Why Choose Our Firm?

  • We have dedicated our professional lives to helping injured people in Los Angeles.
  • We have recovered over $5 billion for all clients collectively since the firm’s establishment.
  • We never back down from a fight; aggressive legal teams do not intimidate us.
  • We have 10 convenient offices located throughout Southern California.
  • We accept all product liability and defective product cases on a contingency fee basis.

Do You Need a Lawyer?

It is not easy to bring a defect claim against a product manufacturer alone. Manufacturers often have thousands of dollars to dedicate toward disputing liability and fighting claims. The manufacturer will want to do everything it can to fight your claim and protect its reputation. Level the playing field by hiring an attorney from Rose, Klein & Marias LLP. One of our lawyers can aggressively defend your case and represent your best interests during insurance settlement negotiations. We can make sure no manufacturer or insurance company takes advantage of you during your time of need.

Types of Defective Product Cases We Handle

Our law firm takes pride in the fact that we have served people in Los Angeles and Southern California for over 80 years. We are focused specifically on the needs of injured people. We want to put our focus to work for you.

We are able to handle all product liability cases involving defective or bad design, including:

  • Defective cars and automotive parts: rollovers, tire defects, airbag defects and more
  • Defective construction equipment: earth movers, cranes, bulldozers, scaffolding, ladders and more
  • Defective factory and manufacturing equipment: dye press, roller machines, punch press, press brakes, conveyor belts and more
  • Defective child products: child safety seats, strollers, toys and more

Our goal is to maximize the compensation you receive in your personal injury or wrongful death case. We believe that we are in a unique position to achieve that goal. Our team includes both personal injury and workers’ compensation lawyers. This is important because many accidents involving defective products occur on the job. For example, a factory worker hurt by a punch press on the job may be eligible to pursue workers’ comp as well as compensation from the manufacturer of the defective piece of equipment.

No matter what type of defective product your case involves, you can rest assured that we will put forth all of our energy, all of our drive to see that you get the results you need. We handle all cases on a contingency basis. We only charge a fee if we get compensation in your defective product case.

3 Types of Product Defects

Product liability laws state that a manufacturer or distributor will be strictly liable for a defective product it creates if that product causes a consumer injury or death. Strict liability means the manufacturer will be legally responsible even if it was not negligent. Strict liability laws serve to protect consumers from manufacturing companies that have extensive resources to dispute liability. Strict liability laws will typically apply if the product contained one of three types of defects.

  1. Manufacturing defects. Issues or errors during the manufacture or assembly of an item.
  2. Design defects. Mistakes in the design of the item that make it inherently dangerous.
  3. Marketing defects. Lack of proper instructions or warnings to protect consumers.

If the item that caused your recent injuries contained one of these three types of defects, you will most likely have a strict product liability claim against the manufacturer and/or distributor. Otherwise, your lawyer may need to base your case on the grounds of negligence or breach of warranty. Speak to a lawyer at our firm today for information about your specific claim.

Is There a Time Limit?

Like all civil claims in California, product liability cases come with strict deadlines for filing. If you miss your deadline, you will, unfortunately, lose any right to compensation in most cases. The courts only allow very limited exceptions to the statute of limitations. The statute of limitations in California on product liability cases is two years from the time you discover or reasonably should have discovered your injuries.

The date you discover your injuries could be the same as the incident itself, such as in an explosion or car accident, or you might not recognize your injuries until later. If a surgeon implanted a defective hip replacement in your body, for example, you may not realize the item has an issue until months or years after the surgery. The California civil courts give you two days from the date of discovery of the injury to file.
